Terms and Conditions

Mountaineering, mountain walking and climbing all have an element of risk associated with it, as stated in the British Mountaineering Council participation statement. "The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions."

By paying and booking the the course/activity fee the date is set and the client is accepting the Terms and Conditions stated on this document.

Participants agree to follow the direction and decisions of their guides/instructors. If you do not, you release yourself from guides/instructors responsibility.

 

Participants must inform the instructor/guide of any current medical conditions.

 

No guarantee is made for clients to reach the summit of a particular peak.  Safety overrides any other objective.  Clients must agree to follow the decisions of the instructor/guide.

 

Under 18s must be accompanied on activities/courses by a legal guardian.

 

The instructor/guide is under no obligation to replace/repair personal belongings lost or damaged whilst under our care, not caused by the negligence of the instructor/guide.

 

The instructor/guide has the right to refuse or accept individuals on activities/courses if deemed to be inappropriately dressed and or under-prepared, under the influence of drugs and/or alcohol or of an unstable character.

 

Clients agree to pay the full replacement cost of any hired/borrowed equipment due to misuse or negligence.

 

It is recommended that you take out your own personal accident/cancelation trip insurance.

Course Booking

​

A 50% deposit is required upon booking more than 6 weeks in advance, less than 6 weeks and the full balance is required to confirm booking.

​

Upon payment of the deposit that secures the date, number of participants and guide(s) for the course/activity.

 

If details of booking change after deposit has been paid without The Highland Mountain Company being notified, we are under no obligation to accommodate for these changes.

Once the deposit has been paid, it is non-refundable

​

The total balance is payable 6 weeks before the course date. Any bookings made within 6 weeks of the start date are required to be paid in full.

​

If the balance is not paid according to terms stated above, then The Highland Mountain Company is under no obligation to reserve the date of activity/course.

Cancellations

​

Deposits are not subject to a refund upon cancellation by the client.

​

Cancellations made before the 6-week period of the course will receive a refund of the balance if already paid.

 

Cancellations within the 6-week period before the course will receive no refund.

 

If The Highland Mountain Company is not notified of a drop in numbers booked leading up to the course, no refund will be given of deposit or balance.  If The Highland Mountain Company is notified, refunds are subject to terms stated above.

 

Once an activity/course has commenced but the full activity/course is not completed there is no obligation by the instructor/guide to offer another date/activity.

 

If the weather or ground conditions are deemed by the instructor/guide to prevent the activity/course from sensibly commencing from the outset, then another similar activity will be offered on date booked.  If the client chooses not to accept the alternative activity offered on the date booked, then no refund will be given.

 

If The Highland Mountain Company cancels the activity/course, participants will either be offered another mutually agreed date, or a full refund.

If more than one instructor/guide is booked for an activity and The Highland Mountain Company cancels the activity from the outset with the client not wishing to re-arrange to another date, a full refund will be given, less the additional instructor(s) fee for the day(s).

 

If another date is mutually agreed upon for whatever reason, this date is then set and will not be changed again.  If the client can then not make this second date after agreement, the instructor/guide has no obligation for rearranging or refund.

The group or individual is considered one booking and the group chooses between a refund or re-scheduling upon the activity being cancelled by The Highland Mountain Company, rather than individual members choosing between the two options.

 

In the event of a re-scheduled activity/course The Highland Mountain Company is under no obligation to assist with additional costs incurred related to: hire equipment, accommodation, food, transport etc
